Our Mediation Preparation Process:
It is expected that each Party to the Mediation will agree to execute a Mediation Agreement entered into for the purposes of attending Mediation and therefore shall agree to deliver to the Mediators at estatemediators.ca and to all other Parties at least 7 days prior to the Mediation the following:
- a mediation brief, or concise statement or account of the following: the issues to be mediated, the parties interests in the subject matter, and, if possible, the desired outcome or settlement position arising out of the Mediation together with copies of any existing Offers to Settle made;
- the governing documents, financial information, relevant statement, documents, Will, Trust, Powers of Attorney, Estate Accounts, Tax Returns, Agreements, Contracts, (if applicable), or other documents at issue and the Pleadings, Application Record, Motion Record, Statement of Claim, and Affidavit of Documents of all Parties and any legal argument relied upon; and
- any other relevant information or documentation known at the time of booking the Mediation which is current as at the date of the Mediation.
- Please note that all materials shall be delivered by the respective Parties, IN DUPLICATE, to estatemediators.ca:

- Your Mediators shall provide Notice of the location of the Mediation at the time that the Mediation is booked
- Your Mediators cannot guarantee that they will be in a position to read all materials delivered less than 3 days prior to the Mediation. Therefore it is prudent to provide Mediation Materials in a timely manner to ensure your Mediators are fully prepared
- The Mediation will commence at 10:00 a.m. unless agreed otherwise between the Parties and the Mediators
- Each Party may sign a separate copy of the Mediation Agreement in advance, and may deliver it by fax to: 416-925-7464. All separately signed copies shall together constitute the Mediation Agreement. The Mediators will keep the Mediation Agreement and will provide each Party with a photocopy of it upon request
- The format of the Mediation will be by Group, Caucus, and individual break-out sessions and will be determined on a case by case basis with the Mediators in advance of the Mediation
