Costs of the Mediation
The Parties participating in the Mediation and who enter into the Mediation Agreement for the purposes of attending Mediation, acknowledge that they are aware of the Mediators' Fees and agree to be bound by such fees set out in the Mediation Agreement including:
- that each Party is responsible for his or her lawyer's fees and all fees of all other professional advisors retained with respect to the Mediation
- that the Mediators' fees shall include a retainer of $8,000.00 provided on or before 7 days prior to the date of the Mediation as compensation for a preliminary review of the materials prior to the mediation charged on an hourly basis at the combined hourly rate of $600.00 per hour
- that the day of the Mediation shall be charged on a per hour basis at the combined Mediators' rate of $600.00 per hour until 5:00 p.m., after which time the combined hourly rate shall be $675.00 per hour
- that the costs of the Mediators' facility shall be borne by the Parties as a cost of the Mediation
- that the costs of any disbursements for food, supplies, photocopies, or other shall be paid for by the Parties as a cost of the Mediation, and that the Costs of the Mediation shall be borne by the Parties as directed by the Parties and the arrangements for same determined with the Mediators at the time of booking the Mediation
- that the Parties have agreed to submit a retainer fee to compensate the Mediators for an unspecified period of time
- that the Parties acknowledge that on the day of mediation, a $8,000.00 non-refundable retainer is to be received by the Mediators and any additional fees will be billed and are due and payable upon receipt of invoice
- that the Mediators are entitled to compensation for all time spent on the case, including preparation time, telephone time and attendance at Mediation sessions
- that travel time is charged at the full hourly rate
- that the costs remitted will also include a flat fee of $500.00 for time spent on case administration, including initial intake calls, scheduling, postage, fax and file administration
- that if the Mediation is rescheduled within 24 hours of the agreed-upon mediation date, an additional $500.00 administration fee shall be charged
- that if the Mediation is cancelled once the materials have been provided and reviewed, a fee of $2,500 will be charged or forfeited from the retainer for time and the administration fee associated with the mediation as well as disbursements and HST, and will not be refunded.
